Pe 26 ianuarie 2012, Romania a semnat in Japonia controversatul tratat ACTA ( Anti-Counterfeiting Trade Agreement ) ce marchează inceputul unui Ev Mediu al Internetului pentru fiecare dintre noi.
Modalitatea in care s-a realizat negocierea acestui acord il privează de credibilitate democratică si de claritate juridicanumeroase prevederi ale sale fiind incă secrete. Deși a fost negociat timp de șase ani totul a fost desfășurat in el mai strict secret.
Implicațiile acestui tratat sunt dintre cele mai sumbre pentru oricine folosește Internetul iar cel mai grav este faptul că toate mijloacele de control și informațiile personale ale oricarui internaut vor fi la dispoziția unor companii private.
În acest mod se eludează controlul exercitat de organele statului sau de catre autoritățile public alese, iar deținatorii drepturilor de proprietate intelectuală vor avea access la viața personală a oricarei persoane fară a necesita un mandat sau o hotarare judecatoreasca
Dar ce inseamnă ACTA pentru fiecare dintre noi, ultilizatorii de Internet?
Furnizorul dumneavoastră de Internet va avea obligația să va monitorizeze intreaga activitate online. Siteurile pe care navigați, tranzacțiile financiare online, discuțiile prin intermediul programelor de tip messenger, tot ceea ce faceti online va fi monitorizat cu grijă de catre angajații acestor companii și oferit la cerere oricarei firme care are cea mai mică suspiciune că aceste activități au condus la incalcarea drepturilor de autor deținute de acestea.
Aceștia vor opera după propriile reguli, nimeni nu vă va aduce la cunoștiintă că are loc această monitorizare și nu veți avea nici un mijloc să va protejați. Practic vor putea face orice cu aceste informații, inclusiv folosirea lor in scopuri publicitare Dreptul la viața privata este incalcat in mod grosolan, cu acceptul statului, care a ratificat acest tratat.
Dacă aveți un site sau un blog acesta va putea fi inchis oricand in urma unei simple cereri din partea unei companii care se va plange firmei unde acesta este gazduit că materialele postate acolo contravin drepturilor de autor.
Nu contează că acestă incalcare poate fi o simplă imagine sau cateva randuri luate dinr-un articol publicat in altă parte. Cei ce au avut ocazia să vadă textul tratatului au menționat faptul că aceste prevederi sunt in mod intenționat cat mai vagi, pentru a simplifica inchiderea unui site.
Conscințele acestui tratat nu se opresc doar aici, ci vizează chiar și liberatea de opinie.Dacă un site devine mult prea incomod pentru un guvern sau o companie, acestea pot cere oricand inchiderea acestuia, sub diverse pretexte.
Parlamentul European, in cadrul unui studiu asupra Acordului, a declarat că este"dificil de stabilit care sunt avantajele semnificative pe care ACTA le oferă cetatenilor UE in plus fată de cadrul international existent."
In studiu se arată de asemenea că "acceptarea neconditionată a Acordului ar reprezenta un raspuns inadecvat din partea Parlamentului European, avand in vedere problemele care au fost identificate in legatură cu versiunea actuală a ACTA".
Cu toate acestea, 22 de țări membre ale Uniunii Europene, incluzand Romania, au semnat acest tratat. Perspectivele deschise de ACTA sunt sumbre, iar drepturile omului par a nu avea nici o importanță pentru autoritățile romane, semnatare ale acestui tratat.
De ce un acord cu consecințe atat de dezastruoase pentru drepturile noastre a fost semnat fară o consultare publică sau Parlamentara?

Activitatea userilor este monitorizata si acum, dar va deveni oficiala odata cu acceptarea acestui tratat. Mai trist e cu SOPA.
Faptul ca au adus in discutie internetul a furat ochii la fooooarte multi de la adevaratul scop al acestei legi: control si mai mare asupra noastra.
Cand am vazut referirea facuta la drepturile de autor mi-a venit automat in minte asa zisa inventie: organismele modificate genetic. Lumea nu prea stie nimic despre astea dar deja le mancam in doza zilnica fara a fi informati.
Astea sunt noile lor arme de distrugere in masa pentru care tintele lor, noi oamenii, mai si platim pe deasupra. Astia de la monsanto au reusit sa mituiasca comisia care da dreptul de autor pentru o inventie si au obtinut acest drept pentru joaca lor de a Dumnezeu pe organisme vii. Daca va informati putin ramaneti socati. De exemplu, in cazul ochilor sunt manipulate genele care stabilesc culoarea ochilor DAR cei care au facut nu devin PROPRIETARI ai persoanei care are gena respectiva. In cazul plantelor, astia au devenit PROPRIETARI pe ceva ce deja a fost creat pe pamant de Dumnezeu iar pe limbajul celorlati, pe ceva care deja a existat pe pamant de la mama natura.
Ei se joaca cu adn-ul plantelor, amesteca gene de la pesti care traiesc in ape reci cu adn-ul rosiilor pentru a face rosii rezistente la frig, plus de curand, nebunii au amestecat genele de glandele mamare a fmeilor cu adn-ul vacilor pentru a face vacile direct lapte de femeie!!!!!!!! SI automat, devin proprietari pe creatiile lor. Problema e ca, omul de rand este IMEDIAT vionvat daca cultura lui de porumb devine infectata cu porumb modificat genetic, chiar daca omul nu a vrut asa ceva, DAR CUM MASA SA OPRESTI POLENIZAREA, INSECTELE SA INTERACTIONEZE CU PLANTE. Am vazut "lucrari de specialitate" care vorbeau de zone de tampon intre culturi modificate genetic si restul...este incredibil...ca si cum poti opri polenul sa se deplaseze pe kilometri intregi, iar ei vorbeau de zone tampon de cateva sute de metri...e stigator la cer.
Mai mult, monsanto a cumparat in america si semintele lasate de Dumenzeu pe pamant, si automat au devenit STAPII LOR, deci cine vrea cultive porumb, soia, etc. trebuie sa plateasca la monsanto!!!!! Problema e ca pot face asta peste tot in lume!!!! Stiu, sunta aberantm nici un om normal nu poate crede asta, si totusi se intampla:((((
Iar acum legea asta, vine ca o manusa pentru ticalosii astia. Controlul total asupra mancarii noastre este asigurat daca legea asta intra in vigoare.
Plus alte chichite care ingradesc din ce in ce mai mult asa zisa libertate a omul, numai liberi nu traim in lumea creata de acesti ticalosi care se razboiesc cu Dumenzeu!!!
ACTA (Anti-Counterfeiting Trade Agreement) este un acord multilateral care propune o serie de standarde internationale pentru aplicarea drepturilor de proprietate intelectuala. Acordul a fost negociat la nivel global intre mai multe tari europene, SUA, Australia, Coreea de Sud si Noua Zeelanda, printre altele. Tratatul nu se refera doar la pirateria online, cum e cazul SOPA, ci acopera si comertul cu produse contrafacute. Conform unui document intocmit de accessnow.org, ACTA este o amenintare la adresa drepturilor utilizatorilor pentru ca:
ACTA ii forteaza pe furnizorii de Internet sa desfasoare activitati de supraveghere la nivelul retelelor proprii si sa puna la dispozitia detinatorilor drepturilor de proprietate intelectuala datele personale ale presupusilor faptuitori.
Extinderea raspunderii intermediarilor ii va determina pe furnizorii de Internet sa desfasoare activitati de supraveghere la nivelul retelelor proprii si sa implementeze mecanisme intruzive de identificare a presupusilor infractori, cum ar fi monitorizarea la scara larga a comunicatiilor prin utilizarea procedurii de "deep packet inspection", permitand astfel incalcarea grava a vietii private a utilizatorilor. Practic, proprietarii drepturilor de copyright vor avea posibilitatea sa obtina informatii private despre utilizatorii de internet, fara sa aiba nevoie de mandate ale judecatorilor.
The Anti-Counterfeiting Trade Agreement, or ACTA, is a controversial trade agreement negotiated in secret by a handful of countries that seeks to establish international standards for intellectual property right enforcement.
As the United States, Australia, Canada, Japan, Morocco, New Zealand, Singapore and South Korea have already signed the agreement, we have turned our attention to the European Union as the last bastion of hope to stop the ascension of this dangerous agreement. In the EU, ACTA is being decided on a national level, and will soon make its way to the European Parliament for a final consent vote.
It is imperative that Parliament votes No on ACTA. Access, European Digital Rights, and the Trans-Atlantic Consumer Dialogue have put together a booklet (found here) to outline the serious implications from a variety of perspectives (human rights, trade, innovation, democracy and legality). These organisations represent civil society, which has been utterly shut out of negotiations of this controversial and ill-conceived agreement.
So why is ACTA important, and what makes it so controversial?
ACTA lacks democratic credibility because it was negotiated in secret, undermining democratic principles of transparency and multistakeholderism;
ACTA poses a threat to free speech and access to culture by, among other issues, encouraging private companies to police users of the internet;
ACTA threatens privacy, as ISPs will be obliged to carry out surveillance on all users;
ACTA could have a chilling effect on innovation by disincentivizing startups and encouraging anti-competitive behaviour;
ACTA would harm trade by giving the U.S. a structural competitive advantage over other countries in addition to creating barriers for international trade;
ACTA lacks legal clarity with vaguely drafted language, and is clearly not aligned with current international and European legal standards.

"You may have heard that legislation creating compulsory ID Cards passed a crucial stage in the House of Commons. You may feel that ID cards are not something to worry about, since we already have Photo ID for our Passport and Driving License and an ID Card will be no different to that. What you have not been told is the full scope of this proposed ID Card, and what it will mean to you personally.
The proposed ID Card will be different from any card you now hold. It will be connected to a database called the NIR, (National Identity Register), where all of your personal details will be stored. This will include the unique number that will be issued to you, your fingerprints, a scan of the back of your eye, and your photograph. Your name, address and date of birth will also obviously be stored there.
There will be spaces on this database for your religion, residence status, and many other private and personal facts about you. There is unlimited space for every other details of your life on the NIR database, which can be expanded by the Government with or without further Acts of Parliament.
By itself, you might think that this register is harmless, but you would be wrong to come to this conclusion. This new card will be used to check your identity against your entry in the register in real time, whenever you present it to 'prove who you are'.
Every place that sells alcohol or cigarettes, every post office, every pharmacy, and every Bank will have an NIR Card Terminal, (very much like the Chip and Pin Readers that are everywhere now) into which your card can be 'swiped' to check your identity. Each time this happens, a record is made at the NIR of the time and place that the Card was presented. This means for example, that there will be a government record of every time you withdraw more than £99 at your branch of NatWest, who now demand ID for these transactions. Every time you have to prove that you are over 18, your card will be swiped, and a record made at the NIR. Restaurants and off licenses will demand that your card is swiped so that each receipt shows that they sold alcohol to someone over 18, and that this was proved by the access to the NIR, indemnifying them from prosecution.
Private businesses are going to be given access to the NIR Database. If you want to apply for a job, you will have to present your card for a swipe. If you want to apply for a London Underground Oyster Card, or a supermarket loyalty card, or a driving license you will have to present your ID Card for a swipe. The same goes for getting a telephone line or a mobile phone or an internet account.
Oyster, DVLA, BT and Nectar (for example) all run very detailed databases of their own. They will be allowed access to the NIR, just as every other business will be. This means that each of these entities will be able to store your unique number in their database, and place all your travel, phone records, driving activities and detailed shopping habits under your unique NIR number. These databases, which can easily fit on a storage device the size of your hand, will be sold to third parties either legally or illegally. It will then be possible for a non-governmental entity to create a detailed dossier of all your activities. Certainly, the government will have clandestine access to all of them, meaning that they will have a complete record of all your movements, from how much and when you withdraw from your bank account to what medications you are taking, down to the level of what sort of bread you eat - all accessible via a single unique number in a central database.
This is quite a significant leap from a simple ID Card that shows your name and face.
Most people do not know that this is the true character and scope of the proposed ID Card. Whenever the details of how it will work are explained to them, they quickly change from being ambivalent towards it.
The Government is going to COMPEL you to enter your details into the NIR and to carry this card. If you and your children want to obtain or renew your passports, you will be forced to have your fingerprints taken and your eyes scanned for the NIR, and an ID Card will be issued to you whether you want one or not. If you refuse to be fingerprinted and eye scanned, you will not be able to get a passport. Your ID Card will, just like your passport, not be your property. The Home Secretary will have the right to revoke or suspend your ID at any time, meaning that you will not be able to withdraw money from your Bank Account, for example, or do anything that requires you to present your government issued ID Card.
The arguments that have been put forwarded in favour of ID Cards can be easily disproved. ID Cards WILL NOT stop terrorists; every Spaniard has a compulsory ID Card as did the Madrid Bombers, and probably most of the 9/11 criminals. ID Cards will not 'eliminate benefit fraud', which in comparison, is small compared to the astronomical cost of this proposal, which will be measured in billions according to the LSE (London School of Economics). This scheme exists solely to exert total surveillance and control over the ordinary free British Citizen, and it will line the pockets of the companies that will create the computer systems at the expense of your freedom, privacy and money.
If you did not know the full scope of the proposed ID Card Scheme before and you are as unsettled as I am at what it really means to you, to this country and its way of life, I urge you to email or photocopy this and give it to your friends and colleagues and everyone else you think should know and who cares. The Bill has proceeded to this stage due to the lack of accurate and complete information on this proposal being made public. Together and hand in hand, we can inform the entire nation if everyone who receives this passes it on."
